Brush Master Pro provides land management and vegetation clearing services, which may include, without limitation:

-Forestry mulching

-Land clearing

-Related site access and vegetation management services

Service availability may vary by location, season, weather, equipment availability, terrain, and safety conditions.

3. Service Area

We primarily serve Western Missouri and surrounding areas. Acceptance of any project is at our sole discretion based on travel distance, job size, accessibility, scheduling, and other operational considerations.

4. Website Use

By using this website, you agree to use it only for lawful purposes. You may not:

-Interfere with the website’s operation or security

-Attempt to gain unauthorized access to any part of the website or related systems

5. Quotes and Estimates

-Stated project goals and requested scope

All quotes are subject to revision if actual site conditions materially differ from what was represented before work begins.

Quotes are generally valid only for the time period stated in the quote. If no expiration date is listed, we may revise pricing at any time prior to written acceptance.

6. Scope of Work

The scope of work for any project will be limited to the services specifically described in the applicable estimate, invoice, proposal, or written agreement.

Any additional work, including but not limited to expanded acreage, additional passes, debris handling, extra travel, or work involving larger trees, rock, or hazardous conditions, may require a revised quote, change order, or additional written approval.

7. Scheduling and Delays

All scheduling is tentative unless confirmed by us. Project start dates and completion timelines may be affected by:

-Weather

-Soil conditions

-Equipment maintenance or breakdown

-Safety concerns

-Site access issues

-Utility marking delays

-Hidden debris or undisclosed site conditions

-Force majeure events

We reserve the right to reschedule, delay, pause, or stop work when conditions are unsafe, unsuitable, or outside the agreed scope.

8. Customer Responsibilities

The customer is responsible for:

-Providing accurate property and contact information

-Ensuring legal authority to request work on the property

-Clearly identifying property boundaries

-Clearly marking any areas, improvements, objects, or vegetation to be preserved

-Securing pets, livestock, and unauthorized persons away from the work area

-Providing safe and reasonable access to the site

-Disclosing known hazards, debris, soft ground, sinkholes, stumps, wells, septic systems, or other site risks

-Ensuring underground utilities are properly located and marked before work begins where required

-Removing or disclosing hidden debris such as wire, cable, fencing, tires, scrap metal, concrete, vehicles, appliances, or hazardous materials

If boundaries, exclusions, or protected items are not clearly identified in advance, we are not responsible for damage to vegetation, objects, or areas that were not properly disclosed or marked.

9. Utilities and Hidden Conditions

Customer acknowledges that land clearing and mulching work involves risks related to hidden or subsurface conditions. Unless otherwise expressly agreed in writing:

-We are not responsible for damage to underground lines, pipes, cables, sprinkler systems, septic components, drain tile, invisible dog fencing, or similar items that are unmarked, inaccurately marked, privately installed, abandoned, unknown, or outside marked areas.

-We are not responsible for delays, pricing changes, or equipment damage caused by hidden debris, rock, buried materials, or undisclosed site conditions.

We may stop work immediately if hazardous or unknown conditions are encountered.

10. Large Trees and Excluded Work

Unless expressly included in writing, our services do not include:

-Large mature tree felling or removal

-Stump grinding or complete root removal

-Grading or finish dirt work

-Haul-off or disposal of debris

-Burning

-Demolition

-Utility trenching

-Engineering, surveying, or boundary verification

-Environmental remediation or hazardous material handling

If the job requires specialized equipment or subcontracted services, additional terms and charges may apply.

11. Property Impact

Forestry mulching and land clearing are intended to reduce brush and invasive growth, but results will vary by site. Customer understands and accepts that:

-Ground disturbance may occur

-Ruts, tire marks, or surface compression may occur, especially in wet or soft conditions

-Some stumps, roots, or uneven areas may remain

-Vegetation may regrow over time

-Final appearance depends on weather, terrain, vegetation type, and customer’s desired finish level

We do not guarantee a particular agricultural, aesthetic, drainage, erosion-control, or resale outcome unless specifically stated in writing.

12. Payment Terms

Payment terms will be stated in the estimate, invoice, or written agreement. Unless otherwise stated in writing:

-Deposits may be required to reserve scheduling

-Progress payments may be required for larger jobs

-Final payment is due upon completion of work

-Invoices not paid when due may accrue late fees or interest to the maximum amount permitted by law

-Customer is responsible for reasonable collection costs, attorney’s fees, and court costs if collection action is required where permitted by law

We reserve the right to suspend work, withhold scheduling, or decline future projects for unpaid balances.

13. Deposits

Deposits, if required, are used to reserve scheduling, planning time, mobilization, and administrative costs. Unless otherwise stated in writing, deposits may be non-refundable once the job is scheduled, mobilization begins, or pre-job planning has been completed.

14. Cancellations

If you need to cancel or reschedule, please notify us as soon as possible. Unless otherwise agreed in writing:

-Cancellations made less than 48 hours before the scheduled start may result in forfeiture of deposit

-We may charge reasonable mobilization or lost scheduling costs if equipment, labor, or travel has already been committed

-Repeated cancellations or no-shows may result in refusal of future service

15. Warranties Disclaimer

To the fullest extent permitted by law, our website, estimates, and services are provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including but not limited to:

-Merchantability

-Fitness for a particular purpose

-Non-infringement

-Availability, accuracy, or uninterrupted access to the website

-Any guarantee of a specific site result or land-use outcome

16. Limitation of Liability

To the fullest extent permitted by law, Brush Master Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

-Loss of use

-Loss of profits

-Loss of property value

-Crop or vegetation loss

-Delays

-Regrowth

-Drainage or erosion issues tied to pre-existing conditions

-Damage arising from unmarked utilities, hidden debris, or undisclosed hazards

Our total liability for any claim arising out of or related to the website or services shall not exceed the amount actually paid by the customer to Brush Master Pro for the specific service giving rise to the claim.

17. Indemnification

You agree to defend, indemnify, and hold harmless Brush Master Pro and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of:

-Your breach of these Terms

-Your inaccurate or incomplete property information

-Your failure to identify boundaries, hazards, exclusions, or utilities

-Your misuse of the website

-Work requested by you on property you do not own or control

18. Intellectual Property

All website content, including text, logos, photos, graphics, branding, and layout, is owned by or licensed to Brush Master Pro and protected by applicable intellectual property laws. You may not use our content without prior written permission.

20. Communications
